This document outlines the terms and conditions governing the use of the Site and the services provided by PurchaseBids (the Services). By registering to use the Site and the Services, you accept and agree to the terms of this PurchaseBids User Agreement (this Agreement). If you do not agree with these terms, you may not access the Site or use the Services.
1.1 Eligibility.
You may only use our Services if you are at least 18 years of age, mentally competent, and can form legally binding contracts under applicable law. Your account or user identification cannot be assigned or transferred to any other party.
1.2 Your Affirmations in Connection with Purchases.
By using our Site and Services, You affirm that You will be financially responsible for concluding a transaction and making payment with respect to any proposal accepted by login with your details. You also affirm that You are a real person or entity with a verifiable address, telephone number, and email address. You agree to act in good faith and not attempt to defraud, cheat, or wrong PurchaseBids or any Vendor. Additionally, You affirm that You are fully capable of paying for services for which You request proposals/subscribed for.
1.3 Accuracy and Nature of Your Information.
You are solely responsible for the accuracy of all information You provide to Us, Vendors, or other users on our Site (Your Information). Your Information will not be false, inaccurate, or misleading, violate any law, statute, ordinance, or regulation, or be defamatory, trade libellous, unlawfully threatening, or unlawfully harassing. By providing Your Information, You grant PurchaseBids a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use Your Information for facilitating communications and transactions through our Site.
1.4 Fees.
PurchaseBids charges a fee for You to register for the subscription models presented in the website. However, PurchaseBids may charge for other Services as indicated on the Site. You are responsible for paying all fees inclusive of all applicable taxes associated with transactions effected through the Site.
1.5 No Disruption to Site Our Services
You Agree not to attempt any action that may disrupt our Site or Services. This includes ensuring that Your Information and all other input on our Site do not contain any harmful software or devices. You will not reverse engineer our Services, use automated processes to monitor our web pages, or take any action that imposes an unreasonable load on our infrastructure.
1.6 OTP login
Ensure the confidentiality of your OTP login details. Do not share your unique code or any other information for accessing the Site and Services with third parties.
1.7 Obligation to Ensure Compliance with this Agreement.
You agree to ensure that Your employees, contractors, and agents comply with the terms of this Agreement. You acknowledge responsibility for any damages, claims, liabilities, and expenses arising from actions taken by parties using Your login information.
1.8 Consent to E-Mail/Whatsapp/Push notification Correspondence from PurchaseBids.
You agree to receive future correspondence via electronic mail (e-mail)/Whatsapp messages/ apps push notification from PurchaseBids, notifying You of bids, proposals, or other relevant matters.In case if you don’t need any correspondence, request to opt out from the platform.
1.9 Electronic Signature.
By checking the box indicating Your agreement to be bound by these terms, You provide consent to these terms and conditions, meeting the requirements of the Consumer Consent Provision of the Electronic Signatures Electronic Communication Act.
In requesting proposals on our Site or accessing our Site and Services, You represent, warrant, and agree to the following:
2.1 Deposits.
PurchaseBids reserves the right to require an earnest money deposit before or during any requests for proposals at its sole discretion or at the discretion of the seller.
2.2 Payment.
Upon accepting a subscription proposal for the delivery of services from purchasebids website, You agree to make payment according to the terms specified in Your request for proposals.
2.3 Failure to Complete Transaction.
If You accept a proposal and fail to complete the transaction, PurchaseBids may enforce remedies, including requiring completion of the transaction, suspension or termination of Your access to our Site and Services, or the sale of services offered with losses and expenses charged to You.
2.4 Legal Compliance.
You will comply with all applicable laws, statutes, ordinances, and regulations regarding Your use of our Site and Services.
3.1 Absence of Liability.
PurchaseBids will not be held responsible for actions or inactions of documents of tender posters and tender buyers, including the quality or condition of information. PurchaseBids provides a marketplace for transactions. PurchaseBids has no control over the accuracy or completeness of proposals, document buying and selling capabilities, or the completion of transactions.
3.2 Disclaimer of Warranties.
THE SITE AND SERVICES, INCLUDING ALL CONTENT, FUNCTIONS, MATERIALS, AND INFORMATION, ARE PROVIDED "AS IS," "AS AVAILABLE." PURCHASEBIDS DISCLAIMS ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PURCHASEBIDS DOES NOT WARRANT THAT THE SERVICES, FUNCTIONS, FEATURES, OR CONTENT WILL BE FUNCTIONAL, TIMELY, SECURE, UNINTERRUPTED, OR ERROR-FREE. PURCHASEBIDS MAKES NO WARRANTY THAT THE OFFERS OR PROPOSALS, THE SITE, OR THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
3.3 Interruption of Service.
PurchaseBids is not responsible for damages or losses related to system errors or interruptions affecting its Site and the processing of solicitations, subscription, requests, offers, bids, auctions, or sales. The Site and Services may be unavailable unexpectedly.
3.4 Third Party Links.
This site might link to other sites or resources.PurchaseBids is not responsible for the availability or accuracy of such sites or resources, and the inclusion of any link does not imply endorsement.
3.5 Release.
In the event of a dispute with a Vendor or another user, You release PurchaseBids from claims, demands, and damages arising out of or connected with such disputes. You agree to settle disputes without PurchaseBids' involvement, and PurchaseBids will have no liability arising from communications or transactions on the Site.
3.6 Indemnity.
You agree to indemnify and hold PurchaseBids harmless from any and all debts, liabilities, obligations, claims, suits, judgments, damages, expenses, and demands arising from Your breach of this Agreement or any act in contravention of relevant laws or infringement upon the rights of any third party.
3.7 Tender Announcements
Only Purchasebids has the exclusive right to announce all tenders that are made available through the Purchasebids platform. Any attempt by users to announce or publish tenders independently on the Platform is strictly prohibited.
3.8 Payment Currency
All payments made on the Purchasebids platform, including fees and transaction amounts, shall be conducted exclusively in United States Dollars (USD) and are non-refundable. Users are responsible for any currency conversion or exchange rate fees associated with such transactions
We take your privacy seriously. We never sell or rent your personal information for marketing without your clear permission.Your information is used as described in PurchaseBids' Privacy Policy. (refer the privacy policy under other terms & conditions which is an integral part of this agreement)
PurchaseBids reserves the right to suspend or terminate Your access to the Site and Services for any reason without notice, including breach of this Agreement, fraudulent activity, manipulation of prices, inability to verify or authenticate information, or actions causing legal liability.
This Agreement is governed by the laws of England and Wales. Any dispute arising out of or relating to this Agreement, including its existence, validity, interpretation, performance, breach, or termination, will be referred to and finally resolved by arbitration as governed by the ICC Arbitration Rules.
PurchaseBids reserves the right to modify this Agreement at any time. Amendments will be effective upon posting on the Site. Your continued use of the Site and Services after the posting of amendments constitutes acceptance of the updated Agreement.
This Agreement constitutes the entire agreement between You and PurchaseBids, superseding any prior agreements.Waiving any provision of this Agreement does not imply a continual waiver of that specific provision or any other provision.If any provision is found invalid or unenforceable, the remaining provisions will be enforced to the fullest extent possible.
By checking the box indicating Your agreement to be bound by these terms, You acknowledge having read, understood, and agreed to the terms and conditions of this PurchaseBids User Agreement.
